Lawyer (Professional Conduct)

Role Overview

As a Lawyer within the Professional Conduct team of the Legal Services Commission, you will play a vital role in evaluating, investigating, and reviewing complaints regarding legal conduct, advising on appropriate actions and assisting with preparations for prosecutions or other enforcement steps. The position predominantly deals with matters arising in private practice, where experience in private legal sector practice is advantageous to effectively address complaints and investigations.

Key Responsibilities

• Engage independently and collaboratively with colleagues including lawyers, investigators, regulatory litigators, and the Commissioner to support regulatory duties under the Legal Profession Act 2007.
• Communicate clearly with diverse audiences, ranging from senior legal professionals to members of the public with limited knowledge of legal systems.
• Evaluate and provide advice regarding complaints within the Commission's jurisdiction according to the Commissioner’s performance standards.
• Conduct thorough assessments, investigations, and reviews of complaints involving lawyers, law practice staff, and unlicensed operators, recommending Commissioner's actions where appropriate.
• Detect apparent misconduct absent a formal complaint and advise on initiating investigations when warranted.
• Support other Commission teams, including the Litigation Division, by assisting with preparations as operational needs arise.
• Advocate for and suggest enhancements to Commission policies, procedures, work practices, and management systems to advance service quality and operational effectiveness.
• Contribute to various Commission initiatives such as projects, research efforts, policy development, and educational programs.

Professional Conduct & Eligibility

• Maintain strict adherence to the Australian Solicitor Conduct Rules and uphold impeccable professional ethics.
• Be eligible for appointment as an investigator under the Legal Profession Act 2007, subject to Commissioner approval.
