Constitutional Law Team Responsibilities

The Constitutional Law Team handles a variety of complex legal matters, including:

  • Providing expert advice on intricate Commonwealth and state constitutional law issues, such as notices under s.78B of the Judiciary Act 1903 (Cth), inconsistencies between Commonwealth and State laws, and limitations on State power (including Chapter III of the Constitution and the implied freedom of communication).
  • Advising government on complex and significant matters, including statutory interpretation outside specific team expertise and miscellaneous government law issues of fundamental importance to the State.
  • Assisting the Attorney-General with their duties as the First Law Officer, including managing ministerial correspondence and granting fiats.
  • Offering advice and potential representation in matters concerning the interpretation and application of the Human Rights Act 2019. This involves advising clients on legislative interpretation and compatibility with human rights, advising the Attorney-General on notices under ss 52 and 53 of the Human Rights Act, and assisting with the preparation of Statements of Compatibility for legislation.
  • Instructing the Solicitor-General and other counsel in high-stakes matters before the High Court and other State and Federal Courts, focusing on constitutional and human rights law.
